O acesso às informações públicas insere-se no contexto do direito à informação, dentro de uma tendência mundial de torná-las acessíveis à sociedade. A regulamentação e implementação de um instrumento jurídico, lei ou decreto corrobora para legitimar o direito à informação que, no Brasil, tem aspecto constitucional. A partir da regulamentação da Lei de Acesso à Informação (LAI) no plano federal (Lei, nº. 12.527/2011) e nas demais esferas e poderes nacionais, pressupõe-se que atores arquivísticos (arquivos públicos estaduais, associações profissionais e cursos de graduação em Arquivologia) não tiveram uma atuação relevante nos processos estaduais de implementação. Neste contexto, indagou-se: Qual o papel desempenhado pelos arquivos públicos estaduais, associações profissionais e os cursos de graduação em Arquivologia na implementação estadual da LAI no Poder Executivo dos estados brasileiros? O recorte temporal da pesquisa foi de 2011 a 2015. Os procedimentos metodológicos adotados foram: revisão de literatura de assuntos referentes ao acesso à informação e direito à informação; a análise de sites institucionais e documentos oficiais e a coleta de dados junto aos atores arquivísticos por meio do envio de questionários. A partir da regulamentação da LAI nos entes federativos e dos dados coletados foi possível identificar as distintas arquiteturas jurídico-legais nas esferas de governo, a começar pelos órgãos gestores da lei, até a inserção ou não dos arquivos públicos estaduais à frente dos procedimentos e atividades relacionados ao acesso à informação pública. Conclui-se que, de modo geral, os atores arquivísticos não exerceram um papel relevante na regulamentação dos instrumentos jurídicos nos estados analisados.@pt

Access to public information is part of the context of the right to information, within a global trend to make them accessible to society. The regulation and implementation of a legal instrument legitimize the right to information. From the regulation of the Access to Information Act (LAI) at the federal level (Law no. 12,527 / 2011) and in other state brazilian spheres, it is analyzed if archival actors (state public archives, professional associations and Archival Science undergraduate courses) had a relevant role in states processes of LAI implementation. What is the role of state public archives, professional associations and graduate courses in the implementation of LAI in the executive branch of the Brazilian states? The time frame of the research was from 2011 to 2015. The adopted methodological procedures were: literature review regarding access and right to information; the analysis of institutional sites and official documents and the collection of data from the archival actors by sending questionnaires. It was possible to identify the different legal architectures in the spheres of government, starting with the managers of the law bodies to the inclusion or not of State Archives. It is concluded that although there were exceptions, the archival actors were not major players in the regulation of legal instruments in the states analyzed.@en
