                    [0] => This article analyzes the trajectory of Brazilian educational legislation through the lens of the tension between constitutional guarantees and the limits imposed by macroeconomic policy. Starting from the 1988 Federal Constitution and moving through the Law of Guidelines and Bases of National Education (LDB Nº. 9.394/96) to the National Education Plan (PNE 2014-2024), this work investigates how normative progress—exemplified by FUNDEB and the GDP investment targets for education set in the PNE—is strained by fiscal constraints, notably Constitutional Amendment Nº 95. The methodology is based on bibliographic and documentary research, with theoretical support from the historiography of Dermeval Saviani and the public policy analysis of Bucci and Vilarino. It concludes that the mismatch between legal norms and financial execution keeps Brazilian educational planning in a state of a "letter of intent," requiring the overcoming of austerity logic to realize the right to education.@en
                    [1] => O presente artigo analisa a trajetória da legislação educacional brasileira sob a perspectiva da tensão entre as garantias constitucionais e os limites impostos pela política macroeconômica. Partindo da Constituição Federal de 1988 e atravessando a Lei de Diretrizes e Bases da Educação Nacional (LDB nº 9.394/96) até o Plano Nacional de Educação (PNE 2014-2024), o trabalho investiga como o avanço normativo, representado por exemplo pelo FUNDEB, bem como o investimento do PIB previsto no PNE para a educação, é tensionado por impedimentos fiscais, notadamente a Emenda Constitucional nº 95. A metodologia baseia-se em pesquisa bibliográfica e documental, com suporte teórico na historiografia de Dermeval Saviani e na análise de políticas públicas de Bucci e Vilarino. Conclui-se que o descompasso entre a norma e a execução financeira mantém o planejamento educacional brasileiro em um estado de "carta de intenções", exigindo a superação da lógica de austeridade para a efetivação do direito à educação.@pt
