                                            [0] => This article analyzes the historicity of hate speech and its relationship with the withdrawal of rights, understood as a foundational element of the state of exception. Grounded in the Franco-Brazilian materialist Discourse Analysis framework, it examines how meanings of intolerance and exclusion are produced and naturalized within discursive formations shaped by ideology, politics, and religion. The study demonstrates that hate speech is not an isolated phenomenon, but rather the result of historical and social processes that construct the “other” as a threat, thereby legitimizing practices of discrimination and violence. Through empirical excerpts from the recent Brazilian political context, it shows how such discourses may transcend the symbolic level and materialize into concrete actions, including lethal outcomes. The article also discusses the role of Law as a normative discourse which, despite presenting itself as a guarantor of rights, operates as an ideological apparatus capable of reproducing inequalities. It concludes that confronting hate speech requires not only legal responses but also a critical understanding of its conditions of production and circulation in contemporary society.
 
                                            [1] => O presente artigo analisa a historicidade do discurso de ódio e sua relação com a retirada de direitos, compreendida como elemento estruturante do estado de exceção. A partir da Análise de Discurso materialista franco-brasileira, investiga-se como os sentidos de intolerância e exclusão são produzidos e naturalizados em formações discursivas atravessadas por ideologia, política e religião. O estudo evidencia que o discurso de ódio não é um fenômeno isolado, mas resultado de processos históricos e sociais que constroem o “outro” como ameaça, legitimando práticas de discriminação e violência. Por meio de recortes empíricos do cenário político brasileiro recente, demonstra-se como tais discursos podem extrapolar o plano simbólico e materializar-se em ações concretas, inclusive letais. Discute-se, ainda, o papel do Direito enquanto discurso normativo que, embora se apresente como garantidor de direitos, também atua como aparelho ideológico capaz de reproduzir desigualdades. Conclui-se que o enfrentamento do discurso de ódio exige não apenas respostas jurídicas, mas uma compreensão crítica de suas condições de produção e circulação na sociedade contemporânea.
