This inclusion challenges traditional conceptions about who has the power to create archives and which memories are legitimized by the state. This article aims to critically analyze the inclusion of community archives in the Archives Law from the perspective of its sociopolitical and epistemological effects on the field. The methodology adopted is a documentary and discursive analysis of archival legislation, in conjunction with the literature on community archives and the relationship between archives and power. The study argues that, although inclusion is a symbolic advance, it faces structural challenges, such as the lack of financing mechanisms and specialized training. The article concludes that legal-normative recognition signals a shift from fundamentally state-run document management to a plural, social, and decolonial perspective on archives.
                                            [1] => O Decreto nº 12.599/2025 incluiu os arquivos comunitários na Lei nº 8.159/1991 (Lei de Arquivos). Tal inclusão desafia as concepções tradicionais a respeito de quem tem o poder de constituir arquivos e quais memórias são legitimadas pelo Estado. Este artigo tem como objetivo analisar de maneira crítica a inclusão dos arquivos comunitários na Lei de Arquivos, pela perspectiva dos efeitos sociopolíticos e epistemológicos para o campo. Adota-se como metodologia a análise documental e discursiva da legislação arquivística, em articulação com a literatura sobre arquivos comunitários e as relações entre arquivo e poder. O estudo argumenta que, embora a inclusão seja um avanço simbólico, ela confronta desafios estruturais, como a falta de mecanismos de financiamento e de formação especializada. O artigo conclui que o reconhecimento jurídico-norma-tivo sinaliza uma mudança de uma gestão documental fundamentalmente estatal para uma perspectiva plural, social e decolonial dos arquivos.
