                                            [0] => This article seeks to retake the historical trajectory of the legislation on private archives in Brazil according to the context of legislation that also seeks to frame the archival heritage, highlighting the process of conception and procedure of Law 8.159 / 91. Therefore, it uses as research source documents on the subject, in addition to the dossier of bill 4895/1984. It problematizes the inexistence of a policy of archives until the decade of 1980 and the contradictions of the text with respect to the access and use of private collections. It concludes that for a long time the State was silent on preserving the archival heritage and in the times when it presented solutions to the question, there was a clash of competencies between the National Archives and the National Historical and Artistic Heritage Institute. Finally, the 1991 File Law presents unsatisfactory guidelines regarding the protection, access and use of information sources from private archives.
                                            [1] => Este artigo busca refazer a trajetória histórica da legislação sobre os arquivos privados no Brasil no contexto de uma legislação que busca também enquadrar o patrimônio arquivístico, destacando o processo de concepção e tramitação da Lei 8.159/91. Para tanto, utiliza como fonte de pesquisa documentos sobre o tema, além do dossiê do Projeto de Lei 4895/1984. Problematiza a inexistência de uma política de arquivos até a década de 1980 e as contradições do texto no que diz respeito ao acesso e uso de acervos privados. Conclui que durante muito tempo o Estado foi omisso na preservação do patrimônio arquivístico e nas vezes em que apresentou soluções para a questão, houve um choque de competências entre o Arquivo Nacional e o Instituto do Patrimônio Histórico e Artístico Nacional. Por fim, a Lei de Arquivos de 1991 apresenta diretrizes pouco satisfatórias quanto à proteção, acesso e utilização de fontes de informação oriundas de arquivos privados.
