                    [0] => This article aims to investigate the impact of the application of scanning records in the Brazilian context. Through consultation aimed at managing legal documents (laws and draft laws) and normative devices, we sought to understand the initiatives to make digital representatives (digital objects resulting from the scanning process) as elements capable of producing legal effects, the same way as the originals in the physical environment. In preparing the study spoke out about the development of legislative proposals aimed at scanning, until the approval of Law 12.682, of July 9, 2012, which provided for the preparation and filing of documents on magnetic media, regulating the use of scanning documents in Brazil. In follow-up, we describe projects that utilize digital surrogate documents as invested with presumption of authenticity, citing as examples the patient´s medical record and the processes of the judiciary. After analyzing the evolution of this context, the study findings that demonstrate behind a scenario where the digitalization is becoming increasingly important, and even with the regulations of a law to this matter, still generates discussions about new possibilities of the digital surrogate.@en
                    [1] => Este artigo tem como objetivo investigar as repercussões da aplicação da digitalização de documentos arquivísticos no contexto brasileiro. Por meio da consulta a dispositivos legais (leis e projetos de leis) e normativas voltadas à gestão de documentos, buscou-se compreender as iniciativas de tornar os representantes digitais (objetos digitais resultantes do processo de digitalização) como elementos capazes de produzir efeitos legais, da mesma forma que os originais em meio físico. No desenvolvimento do estudo discorreu-se sobre a evolução das propostas legislativas voltadas à digitalização, até a aprovação da Lei 12.682, de 09 de julho de 2012, que dispôs sobre a elaboração e o arquivamento de documentos em meios magnéticos, normalizando o uso da digitalização de documentos no Brasil. Em seguimento, descreveram-se projetos que utilizam os representantes digitais como documentos investidos com presunção de autenticidade, citando-se como exemplos, o prontuário médico do paciente e os processos do poder judiciário. Após analisar a evolução desse contexto, o estudo traz conclusões que demonstram um cenário onde a digitalização ganha cada vez mais importância, e mesmo com a regulamentação de uma lei para esta matéria, ainda gera intensas discussões sobre novas possibilidades de uso dos representantes digitais.@pt
